Privacy Policy

The protection of your privacy is very important to Intellion AG (hereinafter: „Intellion“ or „we“) when processing your data. The processing of the data collected from visitors to our website is carried out in accordance with the applicable data protection regulations and other legal regulations as they apply to electronic commerce. Detailed information on data processing in connection with our websites, in particular the website www.intellion.com (hereinafter also referred to as “Website”) can be found in the following explanations. We therefore ask you to take note of these and, if necessary, to print them out or save them.

2. Purpose and Legal Basis of Data Processing

The processing of personal data basically serves the purpose of initiating or fulfilling a contract with you. Therefore, data processing takes place in particular in connection with the sale and distribution of our goods and services, as well as for customer administration and analysis (e.g. creation and maintenance of a customer account or a supplier account, maintenance of customer cards, sending of information).

On the basis of a careful assessment of interests, data processing can take place beyond the actual fulfilment of a contract when necessary for the purposes of legitimate interests pursued by us or by a third party. Data processing on basis of our legitimate may take place, for example for:

  • consultation and data exchange with credit agencies and creditor protection associations to determine creditworthiness data;
  • advertising or marketing;
  • measures for business management and further development of services;
  • maintaining a customer database to improve our services; or
  • legal proceedings.

Processing of your data may also be necessary for the purpose of fulfilling various legal obligations (e.g. from commercial law, tax law, money laundering regulations, product-specific regulations).

If, in specific situations, our data processing cannot be based on a statutory provision, we will obtain your consent prior to the processing of your data. If you have given us your consent to process your data, it will be processed in accordance with the purposes and to the extent agreed in your declaration of consent. Any declaration of consent, for example to the sending of our newsletter, can be withdrawn at any time with effect for the future.

3. Use of “Cookies”:

When you visit our website, information in the form of Cookies is temporarily or permanently stored on your computer/device, which automatically recognizes you the next time you visit our website. Cookies are small text files which allow, e.g., the adaptation of an application to the visitor’s interests. If you do not want “cookies” to be stored by Intellion you are asked to configurate your internet browser so that it deletes cookies from the hard disk, blocks all or certain cookies or issues a warning before cookies are stored.

Some cookies are deleted after the end of the browser session when your browser is closed (so-called session cookies). These cookies are technically necessary, e.g. so that you can log in to an application and remain logged in across pages. Other cookies remain on your device for a specified period and enable us or our partner companies or third parties (cookies from third parties) to recognize your browser the next time you visit the website (so-called persistent cookies).

If by individual cookies used by us also personal data are processed, the processing takes place on basis of our legitimate interests in the best possible functionality and security of the website as well as to provide a customer-friendly and effective design when you visit the site.

In addition, when you first visit our Website, we will ask you whether you agree to accept cookies.

4. Automatically Collected Data:

When you visit our Website, the following data, which your Internet browser transmits to us or our web hoster, is recorded by our web server or the web hoster entrusted with its operation and stored in a log file (so-called server log files) as standard:

  • name of the requested file
  • date and time of the request
  • transferred volume of data
  • IP address
  • notification whether the retrieval was successful
  • description of the type of the web browser used
  • requesting domain

The server logfiles contain IP addresses or other data that allow an assignment to a specific user. The data is stored in the log files of our web hoster. These data are not stored together with other personal data of the user. These data are deleted as soon as they are no longer required for the purpose of their collection. Intellion or the web hoster used by us processes this information on the basis of our legitimate interests in order to determine and improve the attractiveness, the services and the content of the Website or to enable a secure provision of our online services.

The data will not be disclosed or used in any other way, unless we are obliged to do so by law. However, we reserve the right to subsequently check existing server log files if there are concrete indications of illegal use of our Website.

5. Processing of Personal Data

You have the right to object at any time to the use of this data for the respective purpose for the future. See also Section 10.

5.2     The personal data collected from you will only be used for the purpose for which you gave it to us or processing of which you gave us your consent. After completion of the contractual relationship, your personal data shall only be stored as long as it is required on the basis of statutory retention periods or obligations (for example on basis of fiscal and commercial laws). On expiry of these periods the data will, however, be deleted, unless you gave your express consent to its further or different use. You can also assert rights during the applicable retention periods, such as blocking your data. Please see Section 10.

5.4    Your personal data will not be transferred to third parties for other purposes than those listed below. We will only disclose your personal data to third parties if:

  • you have given your express consent to this,
  • the disclosure is necessary for the enforcement, exercise or defense of legal claims and there is no reason to assume that you have a overriding legitimate interest in the non-disclosure of your data,
  • in the event that there is a legal obligation to disclose data, or
  • this is required by law for the initiation and/or execution of contractual relationships with you

A transfer of personal data to government institutions and authorities or a collection of such data for this purpose only takes place within the framework of mandatory national laws.

Your data will be forwarded to the following categories of companies for the purpose of processing a contractual relationship (e.g. provision of a service or sale of goods) – depending on the type of the specific contractual relationship – which we regularly use to provide our services or for our contractual performance, in particular:

Banks, insurance companies and payment service providers, shipping service providers, technical provider used by us, tax consultants and legal advisors

To the extent required by law, we will enter into contractual agreements with these service providers in order to ensure that personal data is only processed within our instructions and under appropriate data security measures.

6. Google Analytics

We use the services of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States, a subsidiary of Alphabet Inc., ibid. (hereinafter referred to as “Google”) to optimize our Website. This process is used to evaluate the use of the Website by users and to compile reports on Website activity. The use of Google Analytics to improve our Internet presence and our customer approach is therefore in our legitimate interest.

With the help of the extension _anonymizelp() only a shortened IP address is processed.

This web analysis service from Google Inc. also stores cookies on your computer in meaning of Section 2. The information generated in this way is transmitted to and stored on a Google server in the USA. If the storage of cookies is not desired, please follow the instructions in Section 2.

Alternatively, the deactivation add-on from Google Analytics can be used by the user under the URL http://tools.google.com/dlpage/gaoptout?hl=de. Please note that this is not available for every internet browser. In addition, you can also install an opt-out cookie via this link on your device, in particular for browsers of mobile devices, so that the collection of data by Google Analytics on our Website will be prevented in the future. Please note that when deleting cookies on your mobile device, you must also reinstall the opt-out cookie.

By using our Website, you agree to the processing of the data collected from you by Google for the use of Google Analytics. If necessary, Google will pass on the stored information to third parties if this is required by law or if third parties process this data on behalf of Google.

Google is a member of the EU/Swiss-US Privacy Shield, which sets minimum standards for the protection of personal data of European and Swiss citizens whose data is stored or processed in the United States.

7. Contact Form and Email Contact

On our Website you will find a contact form which can be used for electronic contact. If a user chooses this form, the data entered in the input mask will be transmitted to us and saved with the content of the respective message. These data are:

  • first name and surname
  • email address
  • telephone number

At the time the message is sent, the following data will also be stored:

  • the user’s IP address
  • Date and time of the message

Alternatively, you can contact us via our email address (see Legal Disclosure). In this case, the personal data transmitted with the email will be stored. If you contact us by email, also personal data included in the email will be stored.

In this context, we will not transfer data to third parties unless it is necessary to pursue our claims or there is a legal obligation to do so. Your data will be used exclusively for the processing of the conversation. The processing of the personal data from the input mask of the contact form or an email sent to us serves us solely for the purpose of facilitating communication with you. If you contact us, this also constitutes the necessary legitimate interest in the processing of personal data. The other personal data processed during the sending process is used to prevent misuse of the contact form and to ensure the security of our information technology systems.

8. Applicant Data

From time to time we post job descriptions on our Website under the category “Jobs”. If you send us your application as a result of this or as part of an unsolicited application, we will store your personal data in a secure operating environment to protect it from loss or misuse. We process applicant data taking into account the legal requirements and/or insofar as this is necessary for (pre-)contractual purposes, as well as on the basis of our legitimate interests.

Please note that, in particular, CVs, job references and other information you provide to us, may contain sensitive information about your mental and physical health, racial or ethnic origin, political opinions, religious or philosophical beliefs, membership of a trade union or political party. We do not need information from you that is not usable under equality law or any other national or international equality law. Please also do not disclose to us any confidential information or trade secrets of your former or current employer.

When communicating or sending application documents by e-mail, please note Sectino 6 above.

Your applicant data will only be made available to the persons involved and authorised to the Intellion application process for the purpose of carrying out the application process, e.g. to carry out the application process with you or to be able to offer you an alternative position as part of the application process.

In the event of a successful application, we store the applicant data you have provided, for the purpose of the employment relationship. Otherwise, the applicant data provided to us, will be deleted or returned after completion of the application process, unless you have agreed to a longer storage period.

9.1    Links to Third-Party Websites

Our Website may contain links to other websites. Intellion is not responsible for their privacy statements or content.

9.2    Links to Intellion Online Presences on Social Networks and Platforms

Intellion maintains online presences within social networks and platforms (Xing, LinkedIn) and links to them from our Website. By clicking on the respective buttons (recognizable by the respective logos of the social networks or platforms) you will be directed to the respective online presence. The purpose of these online presences is to communicate with active customers, interested parties and users and to inform them about our services.  When accessing the respective networks and platforms, the terms and conditions and the Privacy Policies of their respective service providers apply. Unless otherwise stated in our Privacy Policy, we only process user’s data if they communicate with us within the social networks and platforms, e.g. post articles on our online presence or send us messages.

9.3    Embedding of Content on the Website

Vimeo

Based on our legitimate interests, we use the service provider Vimeo to include promotional or product videos on our Website. The platform Vimeo is operated by Vimeo, LLC, 555 West 18th Street, New York, New York 10011 (USA).

If you open a subpage of our Website that contains a Vimeo plugin, a connection with the Vimeo servers will be established and the plugin will be displayed. The plugin will then notify Vimeo which subpage of our Website you have visited. If you are logged in as a Vimeo member on your Vimeo account, this information is assigned to your Vimeo account. This information is also assigned to your user account when using the plugin, e.g. clicking the start button of an embedded video file. If you want to avoid this assignment, you must log out of your Vimeo account before using our Website and delete the corresponding cookies from Vimeo.

Google Maps

Based on our legitimate interest, we use Google Maps to display interactive maps and to create route plans. Google Maps is a service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States, a subsidiary of Alphabet Inc. Google also processes personal data from users in the United States and has joined the EU/Switzerland US Privacy Shield Agreement.

With each individual use of Google Maps, Google sets a Cookie within the meaning of Section 2, in order to process user settings and data when displaying the subpage of our Website on which Google Maps is implemented. In particular, Google receives information that you have accessed the relevant subpage of our Website. This Cookie will not be deleted when you close your browser, but expires after a certain period of time, unless you delete it manually beforehand. If you do not agree with this processing of your data, it is possible to deactivate the Google Maps service and thus prevent the transmission of data to Google. To do this, you must deactivate the Java Script function in your browser. However, we would like to point out, that in this case you will not be able to use Google Maps or only to a limited extent.

If you are logged into your Google account while using Google Maps, the aforementioned data will be assigned directly to your account. If you do not wish this assignment to take place, you must log out of your Google account before using Google Maps functions.

Google stores your data as user profiles and uses them for the purposes of advertising, market research and/or the needs-based design of its online presence. According to Google, such evaluation is carried out in particular (even for users who are not logged in) to provide demand-oriented advertising and to inform other users of the social network about your activities on our Website. 10. Information on User Rights:

Upon request, we will inform you in writing as soon as possible whether and which of your personal data is stored by us. If, despite our efforts to ensure that the data is correct and up to date, incorrect data is stored, it will be rectified by us accordingly. In addition to this right to correction, you also have the right to block and delete the personal data we have collected.

In addition to this right to correction, you may also have the right to block and delete the personal data collected by us. It is possible that we may not be able to comply immediately with every request for deletion for legal reasons, above all due to tax or commercial law regulations, or for reasons of smooth contract processing. In this case, we will contact you and discuss with you to what extent we can block the data for further processing and from what point in time a final deletion is possible.

In addition, you have the right to request that we transmit the data to you as a structured, standard and machine-readable format or, at your express request, forward it to a third party.

We use the widespread SSL (Secure Socket Layer) method within our Website. Our security measures are continuously improved in line with technological developments.

This Privacy Policy is currently valid as of 01.01.2019. Due to the further development of our Website and services it contains or due to changed legal or official requirements, it may be necessary to amend this Privacy Policy.
